How eviction works in Kentucky

Day 0
A written notice from the landlord
Court form: AOC-216 Forcible Detainer Complaint (Rev. 4-23)
- If the landlord files in court, the complaint lists the date they gave you written notice to leave. Compare it with the notice you got.(Source: AOC-216 Forcible Detainer Complaint)
- Some cities and counties adopted a state law called URLTA. There, a landlord must give 7 days' written notice for unpaid rent, and 14 days for other lease problems.(Source: KRS 383.660 Tenant's noncompliance; failure to pay rent (URLTA), KRS 383.500 Local governments may adopt URLTA)

Within 7 days of the judgment
If the judge rules for the landlord
Court form: AOC-217 Forcible Detainer Judgment (Rev. 4-23)
- The judgment form orders the tenant to leave within seven days of the judgment.(Source: AOC-217 Forcible Detainer Judgment)

- If you can't afford the appeal filing fee, you can ask the court to waive it.(Source: Evictions (kyjustice.org))
After day 7, with no appeal
Warrant for possession
Court form: AOC-220 Eviction Notice: Warrant for Possession (Rev. 5-14)
- If no appeal is filed by the seventh day, the landlord can get a warrant. The sheriff or constable then puts the landlord back in possession.(Source: AOC-220 Eviction Notice: Warrant for Possession, KRS 383.245 Warrant of restitution after no appeal)

Your court date: what to do and what to bring

Talk to legal aid before your court date if you can.(Source: Evictions (kyjustice.org))
Get to the courtroom at least 15 minutes before the time on your notice. Be on time.(Source: Evictions (kyjustice.org), EVICTIONS - What can I do if my landlord wants me out? (AppalReD Legal Aid))
The court may call roll. When your case is called, stand up and say you are there.(Source: Evictions (kyjustice.org))
Tell the judge if the landlord did not give you the legal amount of time.(Source: Evictions (kyjustice.org))
If you and the landlord make a deal, the court has a settlement form. Still go to court so the court knows about it.(Source: AOC-218 Forcible Detainer Settlement Agreement, Evictions (kyjustice.org))

Legal aid and rent or utility help by county
