Kentucky regulation 807 KAR 5:006 sets notice and delay rules for utilities the Public Service Commission regulates. Section 15 says an electric or gas utility must give ten days' written notice before terminating for nonpayment, and may not terminate before twenty-seven days after the original unpaid bill was mailed; for water, sewer, or telephone the periods are five days and twenty days. Section 15 also says service shall not be terminated for thirty days beyond the termination date if a physician, registered nurse, or public health officer certifies in writing that termination will aggravate a debilitating illness. Section 16 sets a November 1 through March 31 reconnection path for a customer who presents a certificate of need from the Cabinet for Health and Family Services, pays one-third of the outstanding bill or $200 (whichever is less), and agrees to a repayment schedule ending no later than October 15. The Kentucky Cabinet for Health and Family Services publishes that LIHEAP is federally funded, that the Cabinet contracts with Community Action Agencies to receive applications and provide benefits, and that the home heating programme "has two main components: Subsidy and Crisis," and that a third summer cooling component is offered when funding allows. It states the subsidy component "operates in November and December" for residents at or below 130 percent of the federal poverty level, and that the crisis component "operates from early January until the middle of March or until all funds are expended." For crisis, the Cabinet publishes that a household must meet those criteria and be in a crisis situation involving imminent loss of heating energy — stating applicants must provide a utility disconnect notice — or have four or fewer days of fuel oil, propane, kerosene, wood or coal available, or have received an eviction notice citing unpaid rent where heating is an undesignated portion of the rent. It publishes a liquid-resource limit of $2,000, rising to $4,000 where a household member has a catastrophic illness and the assets are used for medical and living expenses, and states that households at or above 75 percent of the poverty level must pay a co-payment of the minimum amount necessary to alleviate the crisis.
