The Social Security Administration publishes four appeal stages and a deadline on each of the first two. It states: "You have four opportunities to appeal our decision" — reconsideration, a hearing with an administrative law judge, review by the Appeals Council, and a federal district court action — and that "You may choose an attorney or other qualified person to help you with the appeal." For the first stage it states: "Once you receive a decision, submit a request for a disability or non-medical reconsideration within 60 days," and names the form Request for Reconsideration (SSA-561-U2). For the second: "Once you get a reconsideration decision, submit a request for a disability or non-medical hearing within 60 days," naming Request for Hearing by Administrative Law Judge (HA-501). SSA states that on a disability reconsideration "An examiner from a Disability Determination Services (DDS) office in your state will review your request and original application" — in Kentucky that is the Education and Labor Cabinet's DDS programme, a different office from the one that took the application. It publishes hearings as held "online, in person, or by phone." Support is published on 1-800-772-1213, "Monday through Friday, 8 a.m. to 7 p.m., in English, Spanish, and other languages," with TTY on 1-800-325-0778. Read the deadline off your own notice rather than this page — the dated notice controls. If a deadline has already passed, ask SSA in writing to accept a late request and say why it was late; whether it does is SSA's decision under rules NOLO has not verified.
